Parental leave and parental benefit

Parental leave:

Mothers and fathers who are in an employment relationship are entitlement to parental leave. The entitlement extends up to the end of the third birthday of the child. Parental leave can be taken in any form of employment. For temporary contracts of academic staff and employees, the Temporary Science Employment Law applies. This allows the renewal of contracts as a result of parental leave.

The employer must be informed of the parental leave no later than seven weeks in advance (the estimated date of birth of the child taken as the starting point). For the form for requesting parental leave at the TU Clausthal, see Forms. (Formular zum Beantragen der Elternzeit)

Parental benefit:

Who is entitled to parental benefit?

Mothers and fathers

  • who look after their children on their own after birth,
  • who do not work more than 30 hours per month,
  • who live with their children in a household,
  • whose place of residence or usual abode is in Germany.

How high is the parental benefit?

The parental benefit stands for 65 to 67% of net income (depending on the amount of net income). The parental benefit amounts to minimum 300 and maximum 1800 Euros per month. A relatively exact calculation is possible through the Parental Benefit Calculator.

How long can the parental benefit be obtained?

Parental benefit can be obtained within the first 14 months of life of the child. It is assumed that both parents share the payment. One parent can obtain parental benefit for minimum 2 and maximum 12 months.

The Parental Benefit Plus (“ElterngeldPlus2) that is applicable as of July 2015 can be obtained in a partnership up to 24 months. It is aimed primarily at parents who wish to return to work early.

Other important information can be found in the Brochure on Parental Leave and Parental Benefit and on the homepage for Parental Benefit Plus of the Federal Ministry.
